These terms and conditions govern sales on the Lilamand Confiseur online shop at www.lilamand.com. These terms and conditions apply to the exclusion of all other terms and conditions, in particular those applicable to in-store sales.
Article 1 – The Offer
Validity period: Offers on the website are valid for as long as they remain online.
Territorial scope: These offers apply to all online purchases for delivery to mainland France and all other destinations.
Article 2 – Validation
When you click on the ‘Order’ button at the end of the ordering process, you confirm that you accept the order and these Terms and Conditions in full and without reservation. The data recorded by the ‘Lilamand Confiseur’ shop constitutes proof of all transactions between the shop and its customers.
Article 3 – Availability
All products on the website are in stock, and our offers are subject to availability.
Should one or more products become temporarily or permanently unavailable, Lilamand Confiseur will do its utmost to update its website. Under no circumstances shall Lilamand Confiseur be held liable for the unavailability of one or more products.
If a product is out of stock after you have placed your order, we will notify you by email within 48 hours (working days). You may then request that your order be cancelled or that the missing item(s) be replaced.
Article 4 – Contribution towards postage and handling costs
Delivery charges are payable by the Buyer and will be invoiced by Lilamand Confiseur for each order. The delivery charge for each order placed by the Buyer will be stated on the order.
Article 5 – Processing and delivery times
Your orders are processed as quickly as possible from Monday to Friday inclusive. Orders are dispatched within 5 working days. Once dispatched, your order will be delivered within 72 hours.
These delivery times apply to working days, excluding any postal delivery issues and subject to product availability.
Article 6 – Cancellation period
The withdrawal period granted to the customer for the purchase of goods is 14 (fourteen) clear days from the date of receipt of their order. During this period, the customer may return, at their own expense and without incurring any penalties, any product(s) that do not meet their requirements.
The customer will then be able to choose between:
- Refund of the amounts paid in return for the return of the product(s)
- Exchanging the product(s) ordered
Any returned products must be in good condition, as delivered by Lilamand Confiseur.

To process your enquiry, please provide your surname, first name, address, date and order number. We are unable to process incomplete enquiries.
Article 7 – Conformity of the products delivered
Upon receipt of their order, the customer has three working days to check that the delivered product is as ordered. Any complaints should be sent to Lilamand Confiseur by:

Unless a complaint is made within the specified time limit, the delivered goods shall be deemed to be in conformity with the order and accepted by the customer.
No returns will be accepted without the written consent of Confiserie Lilamand.
No product will be exchanged or refunded until the returned item has been received, in its original packaging and in good condition.
Article 8 – Payment and confidentiality
A – Prices
The prices of our products listed on the website are in euros and include all taxes. The taxes applied will be those in force at the time of the order, as stated on the invoice and in the order confirmation sent by email.
All orders, regardless of the Buyer’s place of residence, are payable exclusively in euros. Prices are set by Lilamand Confiseur and may be changed at any time, without this affecting orders that have already been placed.
B – Payment terms and methods
Payment for orders must be made in full by credit card. The order will only be confirmed once payment has been received in full.
Our website is protected by a security system. The payment details you enter (card number and expiry date) are encrypted and are not transmitted in plain text over the internet. It is not possible to pay on delivery.
C – Confidentiality of your personal data
Lilamand Confiseur takes the protection of your personal data very seriously. In accordance with the GDPR (EU 2016/679) and the French Data Protection Act, you have the right to access, rectify and object to the processing of your personal data.

Article 9 – Governing law – Disputes
This contract is governed by French law and is written in French. In the event of a dispute, the Court of Tarascon (Bouches-du-Rhône, France) shall have exclusive jurisdiction.

Article 10 – Competent court
These terms and conditions of sale are governed by French law. Any disputes that may arise between the parties shall be finally settled by the Commercial Court of Tarascon (Bouches-du-Rhône, France).
Article 11 – Right to consumer mediation
Any consumer may, free of charge, refer a matter to a consumer ombudsman with a view to resolving any dispute amicably, provided they have first submitted a formal written complaint to our customer service department.
If no agreement is reached within 60 days, the consumer may refer the matter to the relevant ombudsman. The ombudsman will issue a proposal within 90 days of the matter being referred to them.
In the event of a cross-border dispute, consumers may also use the European Online Dispute Resolution platform.
Article 12 – Objection to cold calling
In accordance with Article L.223-2 of the Consumer Code, consumers may register free of charge on the Bloctel cold-calling opt-out list, which can be accessed at: www.bloctel.gouv.fr.
La Confiserie Lilamand s’engage à respecter ce droit et à ne pas contacter les consommateurs inscrits sur cette liste, sauf relation contractuelle en cours ou exception légale.
